The Website

The Website is a tool to facilitate surveyors, engineers and the like (Members) to promote their services to Clients. Members provide information about themselves, their services and their fees (Members Information) which is stored on the Website.  Selected parts of Members' Information may be displayed on the Website and emailed to you in response to your enquires so that you can contact them.  Members will be informed by email whenever any of their information is displayed and/or emailed to you, along with your details so that they can contact you.  We are not involved in any discussions, negotiations or agreements between Members and Clients.

Member's Information

We do not review or check the accuracy or legality of Member's Information.  You are responsible for checking that any Member's Information which you may rely upon is correct.  In particular before placing an order with a member it is your responsibility to ensure that the member has satisfactory qualifications, accreditations, experience and insurance suitable for your requirement.

In the event that any incorrect or misleading Member's Information comes to your attention you must inform us immediately, by email, so that we can request the Member to correct or remove it.

Member's Services and Estimates

Members must only offer to carry out work for which they are sufficiently knowledgeable, experienced, competent and able to carry out, taking into account all relevant factors, including the type of work, the age and type of the property concerned, and its geographical location (Services).  The offer of a Service or the provision of an estimate (Estimate) for a Service through the Website is based on limited information and does not constitute a contract or binding offer.

Client Information

Any information which you provide about yourself to the Website is known as Client Information, and you warrant that this is genuine and correct.  You agree that any Client Information may be passed to Members to allow them to promote their Services to you.  Client Information will be treated with full confidentiality and will not be passed to any other third party.

Continuous Operation

We will use our reasonable endeavors to ensure that the Website and Members Information is always available to Clients.  However, we cannot and do not guarantee a continuous, uninterrupted operation as this could be affected by many factors beyond our control as well as our need to maintain and further develop the Website.

In the event that you have any grievance, complaint or claim against a Member, you agree to pursue this directly with the Member, without involving us. We would request that you do inform us of any such event so that we can take any other actions that we feel appropriate.

Limitation of Liability

Nothing in this agreement shall limit or exclude our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence. Subject to this, we will not be held liable for any loss or damages arising out of this agreement or the operation or non operation of the Website.

Governing Law

What is an Expert Witness?

An Expert Witness is a Chartered Building Surveyor who has experience in all areas of property or construction disputes. Disagreements can arise where there is a difference of opinion and often a technical expert will be needed to help the parties involved reach a resolution. Sometimes the disputes will end up in Court but involvement of an Expert Witness early on will help reduce the chance of this happening and the parties involved may be able to reach a satisfactory outcome through arbitration or mediation instead.

When would it be advisable to use an Expert Witness?

There are many occasions when you may find the services of an Expert Witness useful. Below are a few examples;

Building surveying – A new bathroom has been installed that does not meet current standards and the owner wishes to claim against the installer.

For a planning authority when unauthorised alterations have taken place in a property which have not received the necessary statutory consents

Commercial property – Property portfolios, development / refurbishment of entertainment venues,  offices, shops, factories and warehouses are just some examples of commercial properties. An Expert Witness can be used for a whole host of issues where technical evidence is needed for any dispute or claim. These can include capital and rental valuations, assessment of losses within estate and farm businesses, compensation claims, landlord and tenant disputes, professional negligence claims, or boundary disputes.

Compulsory land purchase orders – In England and Wales, certain bodies have the right to purchase land without the consent of the owner where the development proposed is for the benefit of the public. A Chartered Building Surveyor as an Expert Witness can work on behalf of either the purchasing authority giving strategy advice at Public Inquires and Select Committees or on behalf of the owner providing expert witness advice throughout an inquest.

Construction disputes – An Expert Witness can help building owners and legal advisors assess poor project performance and look at strategies for getting the project back on track. They can also provide technical advice and guidance for rent review appraisals and insurance evaluations.

Dilapidations – An Expert Witness can defend tenants when they disagree with the landlord about the claim being made against them. They will examine the facts and advise if the landlord's proposed works truly reflect a breach of the tenant's repairing covenant.  For the landlord they can help prepare a schedule of dilapidations and dilapidations forecasts.

Planning and development – Sometimes the expansion of an existing development or a new development can raise contentious planning issues. An Expert Witness can provide evidence in support of a development for a public enquiry or an appeal, Consent Appeals for urban design and heritage evidence for Planning, Listed Building and Conservation Area Consent.  Other issues an Expert Witness may become involved with are Enforcement and Call In Inquiries, CPO and Highway/Footpath Order Inquiries, Harbour Revision, Transport and Works Act.  

Valuation – An Expert Witness provides initial reports giving valuations for specific purposes for example in matrimonial or partnership disputes or fixed assets. They will also represent specific interests of clients at court or negotiate on behalf of clients. They have good working knowledge of litigation and Court proceedings.

Before appointing an Expert Witness you should check your chosen supplier has satisfactory qualifications, accreditations, experience and insurance, to provide the level of service that you need. A Charted Building Surveyor who is an Expert Witness must be a member of the Royal Institute of Chartered Surveyors (RICS) and they will  have MRICS or FRICS after their name.
